MORAGO GROUP GmbH
1. Scope
These General Terms and Conditions (GTC) apply to orders placed through the online store morago.store between MORAGO GROUP GmbH (“MORAGO”) and its private and business customers.
2. Conclusion of Contract
The presentation of products in the online store generally does not constitute a binding offer. By completing the order, the customer submits a binding order.
The contract is concluded when MORAGO accepts the order, issues a corresponding order or shipping confirmation, or delivers the goods.
3. Products
The product description and the essential product characteristics applicable at the time of the order shall be decisive.
Product images, renderings and visualisations are provided for illustrative purposes. For products expressly designated as Pre-Order or still under development, technical or design-related further developments may be made, provided that the essential function is retained and the change is reasonable for the customer.
4. Prices and Payment
The prices and payment terms stated in the online store or at checkout shall apply.
Information regarding shipping costs, taxes, customs duties and import charges can be found at checkout and in the separate Shipping Policy.
5. Pre-Order and Deposit
MORAGO may offer selected products as Pre-Orders and may require a deposit.
The deposit will be credited towards the purchase price. The remaining balance must be paid before delivery in accordance with the conditions stated in the respective offer.
Production and delivery dates stated for Pre-Orders are estimates unless expressly designated as binding. MORAGO will inform the customer of any significant delays.
The conditions stated in the respective offer as well as the separate Right of Withdrawal Policy apply to cancellations, withdrawal and refunds. Mandatory statutory rights remain unaffected.
6. Vehicle Compatibility
For vehicle-specific products, compatibility may depend on the model, model year, equipment and individual vehicle dimensions.
Where measurements, photographs or other information are required to verify compatibility, the customer is responsible for ensuring that such information is accurate and complete.
7. Use
The products must be used for their intended purpose and in accordance with the installation, operating and safety instructions.
To the extent permitted by law, MORAGO shall not be liable for damage resulting from improper use, overloading, unauthorised modifications or failure to comply with safety instructions.
8. Warranty and Liability
The statutory warranty and defect rights shall apply.
Normal wear and tear as well as damage caused by the customer through improper use or modifications do not constitute defects for which MORAGO is responsible.
MORAGO shall be liable in accordance with mandatory statutory provisions. Any further limitations of liability shall apply only to the extent permitted by law.
9. Withdrawal, Shipping and Data Protection
The separately published Right of Withdrawal Policy applies to withdrawal and returns.
The Shipping Policy applies to delivery, shipping costs, customs duties and import charges.
The processing of personal data is governed by the Privacy Policy.
10. Applicable Law and Jurisdiction
Swiss law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, mandatory protective provisions of the law that would apply in the absence of this choice of law remain unaffected.
For business customers, Zug, Switzerland, shall be the exclusive place of jurisdiction to the extent permitted by law. For consumers, the mandatory statutory rules on jurisdiction shall apply.
11. Final Provisions
The version of these General Terms and Conditions in force at the time the contract is concluded shall apply to the respective order.
Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected; the applicable statutory provisions shall apply in place of the invalid provision.
